These Terms of Service (“Terms”) govern your access to and use of the website loveyogamontana.com, our booking pages, class registration tools, retail or online store pages, communications, and any classes, workshops, teacher trainings, private sessions, events, retreats, memberships, class packs, merchandise, gift cards, or other services offered by Love Yoga Montana, also doing business as LOVE Yoga & Barre where applicable (“Love Yoga,” “we,” “us,” or “our”).

By using our website, creating an account, purchasing a pass or membership, registering for a class, attending a class, or otherwise using our services, you agree to these Terms. If you do not agree, please do not use our services.

2. Our Services

Love Yoga Montana offers yoga, barre, movement, fitness, wellness, meditation, workshops, events, teacher trainings, private sessions, retreats, retail products, gift cards, and related services. Services may be offered in person, online, through third-party booking platforms, or through other channels we use from time to time.

Schedules, instructors, class formats, locations, amenities, prices, policies, and availability may change at any time. We may modify, pause, cancel, or discontinue any service without prior notice.

3. Eligibility and Accounts

You must provide accurate, current, and complete information when creating an account, booking a class, purchasing a service, or communicating with us.

You are responsible for keeping your login credentials confidential and for all activity under your account. Please notify us promptly if you believe your account has been accessed without authorization.

Minors may participate only with the consent of a parent or legal guardian and subject to our age restrictions, class requirements, and waiver requirements. A parent or legal guardian who registers a minor accepts these Terms on the minor’s behalf.

4. Health, Safety, and Assumption of Risk

Yoga, barre, fitness, heated classes, movement practices, breathwork, stretching, strength training, inversions, use of props, hands-on assists, and related activities involve inherent risks. These risks may include discomfort, muscle soreness, sprains, strains, falls, dizziness, overheating, dehydration, aggravation of existing conditions, and other injury.

By participating, you confirm that you are voluntarily choosing to participate and that you are responsible for your own physical, mental, and emotional well-being. You agree to listen to your body, move safely, ask questions when needed, and stop participating if something does not feel right.

You should consult a qualified healthcare provider before participating if you are pregnant, injured, have a medical condition, are taking medication that may affect exercise, have recently had surgery, or have any concern about whether our services are appropriate for you.

Our services are not medical treatment, physical therapy, psychotherapy, diagnosis, or a substitute for professional healthcare. We do not guarantee any health, fitness, mental, spiritual, therapeutic, or wellness outcome.

5. Waiver and Release

To the fullest extent permitted by law, you voluntarily assume all risks connected with your participation in our services and release Love Yoga Montana, its owners, instructors, employees, contractors, representatives, affiliates, landlords, successors, and assigns from claims arising from ordinary negligence, personal injury, illness, property damage, loss, or other harm connected with your use of our services.

Nothing in these Terms is intended to waive claims that cannot legally be waived under applicable law. We may require you to sign a separate participation waiver, release, or informed consent before attending classes, workshops, trainings, retreats, or events. If a separate waiver applies, it is incorporated into these Terms.

6. Booking, Attendance, and Studio Policies

You are responsible for registering for classes, workshops, events, trainings, private sessions, and other services through our approved booking methods.

Please arrive early enough to check in, set up, and be ready when class begins. We may refuse late entry for safety, class flow, capacity, or instructor discretion.

You agree to follow all posted studio rules, instructor directions, safety instructions, and respectful conduct expectations. We may remove or refuse service to anyone who disrupts a class, creates a safety concern, behaves disrespectfully, harasses others, violates these Terms, or misuses our facilities or services.

7. Late Cancellation and No-Show Policy

Because class space is limited, cancellations and no-shows affect other students.

Unless a different policy is stated at purchase, in the booking system, or for a specific class, workshop, event, training, private session, or retreat, the current class policy is:

If you cancel within the late-cancellation window before class or do not show up, a penalty may apply.

For unlimited memberships, a late-cancel or no-show fee may be charged.

For class pack holders, a class may be deducted from the pack.

For drop-in classes, the drop-in may be forfeited.

The booking system, purchase page, or event-specific terms may provide additional or different cancellation rules. Those specific terms control for that purchase.

8. Purchases, Prices, and Payment

Prices are listed on our website, booking platform, retail store, or in-studio materials and may change without notice. You agree to pay all charges, taxes, fees, and other amounts associated with your purchase.

By providing payment information, you authorize us and our third-party payment processors to charge your payment method for purchases, memberships, recurring payments, cancellation fees, no-show fees, retail purchases, and any other amounts you authorize or owe under these Terms.

We may use third-party platforms for scheduling, payments, memberships, email, text messaging, retail, and other services. Your use of those platforms may also be subject to their own terms and privacy policies.

9. Memberships, Class Packs, and Credits

Memberships, class packs, passes, credits, gift cards, and promotional offers are subject to the terms stated at the time of purchase. Unless otherwise stated or required by law, purchases are personal, non-transferable, and may not be shared, resold, exchanged for cash, or used by another person.

If a membership is recurring, it will continue to renew until canceled according to the cancellation terms stated at purchase or in the applicable booking platform. You are responsible for canceling before the next billing date if you do not want to be charged.

We may suspend or terminate a membership or account for violation of these Terms, nonpayment, chargeback abuse, unsafe conduct, harassment, fraud, or misuse of services.

10. Refunds

Unless a different refund policy is stated for a specific purchase, all purchases are non-refundable except where required by law. This includes class passes, memberships, class packs, workshops, trainings, retreats, events, private sessions, gift cards, and merchandise.

We may, in our discretion, offer account credits, exchanges, transfers, or other accommodations. Any accommodation we provide once does not require us to provide the same accommodation in the future.

Special events, teacher trainings, retreats, private sessions, and workshops may have their own deposit, cancellation, refund, and payment-plan terms. Those specific terms control.

11. Teacher Trainings, Workshops, Retreats, and Special Programs

Teacher trainings, retreats, workshops, private events, and specialty programs may require separate agreements, waivers, payment schedules, deposits, codes of conduct, attendance requirements, cancellation terms, travel terms, and refund rules.

Participation in a teacher training does not guarantee certification, employment, teaching opportunities, Yoga Alliance registration, or any specific professional outcome unless expressly stated in writing.

12. Retail Products and Merchandise

Retail products, apparel, accessories, mats, props, gift cards, and other merchandise may be sold in studio or online. Product availability, descriptions, pricing, and images may change without notice.

Returns and exchanges are handled according to the return policy stated at the time of purchase or required by law. We may refuse returns for used, damaged, final-sale, hygiene-sensitive, or customized items.

13. Communications, Email, and Text Messages

By providing your email address or phone number, you agree that we may contact you about your account, purchases, schedule changes, class reminders, membership notices, payment issues, customer service, safety updates, and other transactional matters.

If you opt in to marketing emails or text messages, we may send you promotional messages about classes, workshops, events, sales, and updates. You can unsubscribe from marketing emails using the unsubscribe link or opt out of promotional text messages by following the instructions provided in the message. Standard message and data rates may apply.

14. Photos, Video, and Media

We may take photos or videos in our studio, at events, trainings, retreats, or community gatherings for marketing, education, social media, website, or promotional purposes. We will seek consent where required by law or where we are featuring an identifiable person in a focused way.

Please tell us if you do not want to be photographed or recorded. Parents or guardians must provide consent for minors where required.

You may not photograph, record, livestream, or post other students, instructors, classes, or private studio activities without permission.

15. Intellectual Property

All website content, branding, logos, class names, text, photos, videos, graphics, designs, training materials, manuals, handouts, sequences, digital content, and other materials created or provided by us are owned by Love Yoga Montana or our licensors and are protected by intellectual property laws.

You may use our materials only for your personal, non-commercial use in connection with our services. You may not copy, reproduce, modify, distribute, sell, teach from, publish, upload, or create derivative works from our materials without written permission.

16. User Content and Feedback

If you submit reviews, testimonials, photos, comments, messages, suggestions, or other content to us, you represent that you have the right to share that content and that it does not violate the rights of others.

By submitting feedback or non-private content to us, you grant us permission to use it for business, marketing, improvement, and promotional purposes, subject to our Privacy Policy and applicable law.

17. Prohibited Conduct

You agree not to:

Use our services for unlawful, abusive, fraudulent, or harmful purposes.

Harass, threaten, intimidate, discriminate against, or harm any student, instructor, employee, or guest.

Disrupt classes, interfere with safety, or ignore instructor guidance.

Share false, misleading, or incomplete account or payment information.

Use another person’s account, membership, pass, or payment method without authorization.

Scrape, copy, reverse engineer, attack, overload, or interfere with our website, booking system, or digital services.

Upload malware, spam, or harmful code.

Violate our intellectual property rights or the rights of others.

18. Third-Party Services and Links

Our website and services may link to or integrate with third-party platforms, including booking systems, payment processors, ecommerce platforms, social media sites, analytics providers, email providers, text-message providers, and other service providers.

We are not responsible for third-party websites, platforms, content, policies, security, availability, or practices. Your use of third-party services is governed by their terms and privacy policies.

19. No Warranties

Our services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, safety, and uninterrupted operation.

We do not guarantee that our website, booking systems, communications, classes, workshops, trainings, products, or services will meet your expectations or produce any particular result.

20. Limitation of Liability

To the fullest extent permitted by law, Love Yoga Montana and its owners, instructors, employees, contractors, representatives, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost data, lost goodwill, personal inconvenience, or business interruption.

To the fullest extent permitted by law, our total liability for any claim related to our services will not exceed the amount you paid to us for the specific service giving rise to the claim or $100, whichever is greater.

Nothing in these Terms limits liability that cannot legally be limited.

21. Indemnification

You agree to indemnify and hold harmless Love Yoga Montana and its owners, instructors, employees, contractors, representatives, affiliates, service providers, and licensors from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms, your misuse of our services, your violation of law, your violation of another person’s rights, or your unsafe or improper conduct.

22. Force Majeure

We are not responsible for delay, cancellation, interruption, or failure to provide services caused by circumstances beyond our reasonable control, including weather, fire, smoke, natural disasters, public health events, power outages, internet outages, labor disruptions, government actions, instructor illness, emergencies, or other events outside our control.

23. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated Terms on our website and update the “Last Updated” date. Your continued use of our services after updated Terms are posted means you accept the updated Terms.

24. Governing Law and Venue

These Terms are governed by the laws of the State of Montana, without regard to conflict-of-law rules. Any dispute arising from or relating to these Terms or our services will be brought in the courts located in Flathead County, Montana, unless applicable law requires otherwise.

25. Severability

If any part of these Terms is found invalid or unenforceable, the remaining parts will remain in effect.

26. Entire Agreement

These Terms, together with our Privacy Policy, any signed waiver, and any purchase-specific terms, form the entire agreement between you and Love Yoga Montana regarding your use of our services.
